Cholota appeared before Magistrate Estelle de Lange for the third time this week as her bail application was postponed twice. Cholota has been in custody since she was extradited from the United States last Thursday.

MOROADI CHOLOTA GRANTED BAIL

Cholota is accused of fraud and corruption, among other charges, alongside her former boss Magashule, infamous businessman Edwin Sodi and others, such as:

• Thabane Zulu, former director-general of national Department of Human Settlements
• Nthimotse Mokhesi
• Mahlomola Matlakala
• Sello Radebe
• Adel Kgotso Manyeki
• Nozipho Molikoe
• Albertus Venter
• Margaret-Ann Diedericks, former head of Gauteng’s human settlements department
• Olly Mlamleli, former MEC and Mangaung mayor

On Tuesday, the National Prosecuting Authority (NPA) said Cholota would most likely flee if granted bail, and in support, they contend that:

• She was extradited from US and did not return to South Africa willingly, while her co-accused – Magashule, Sodi and others – have been availing themselves to the court without coercion
•  She has not seen her child, who resides in South Africa, since 2020
•  She has already settled in the US and has not been to South Africa in approximately five years
•  She has a romantic partner who lives in the US

On Thursday, Cholota’s lawyer argued that she is not a flight risk as all her travel documents were left behind in the United States when she was extradited, and that all her co-accused in the matter are out on bail, so she deserves to be released too.

De Lange said she believed there are conditions that can limit Cholota’s movements and does not support the State’s assertion that she is a flight risk.

“The defence proved to the court that it is in the interest of justice for the accused to be granted bail,” she said.

WHAT ARE HER BAIL CONDITIONS?

• She should be present in court at 8:30 whenever the matter is heard.
• She may not travel outside Bloemfontein and she should consult the investigating officer for consent.
• Lastly, Cholota should report to the nearest police station every Monday and Friday between 8:00 and 17:00.

The magistrate further emphasised that should she fail to abide by the conditions, her bail will be forfeited to the State and a warrant of arrest will be issued.

Cholota who landed at OR Tambo International Airport from Newark Liberty International Airport in the United States last Thursday appeared at the Bloemfontein Magistrates Court on Monday, 12 August in relation to the infamous R255 million asbestos scandal in Free State.

Initially, she was a witness against Magashule and the other accused before she reportedly failed to honour her commitment to cooperating with law enforcement.

She was then added to the list of suspects in the asbestos audit case, where money was stolen and laundered using the cover of a Free State government tender to identify houses with poisonous asbestos in the roofs.

The student has been sitting in a US jail since April 2024, trying to avoid extradition to South Africa by claiming ill-treatment by interrogators. Recently, the Constitutional Court also dismissed her request to nullify the extradition.

On Monday, Cholota told the court that she can only afford bail of R2500.

Notably, Magashule was not in court to support Cholota, however, his party the African Congress for Transformation (ACT) had issued a statement condemning the alleged abused his PA suffered at the hands of police.

The party said Cholota was allegedly harassed and assaulted by the FBI, Interpol and SAPS in order to coerce her into a signing a statement that falsely incriminates Magashule.

“ACT appreciates and commends Cholota for her bravery. She had a choice of signing a false statement that implicates Magashule and walk free, but she chose not to compromise her values and principles.

“She declined to succumb to the blackmail of the FBI and NPA. Instead, she willingly allowed herself to be paraded as a terrorist by Interpol, SAPS and NPA,” the party said.

Bester and his co-accused returned to court after a previous appearance in June for a pre-trial hearing.

Again, Wednesday’s matter was postponed to 31 July for another attempt at a pre-trial conference after Senohe Motsoara and Tieho Makhotsa’s legal representative, Kagisho Moruri, withdrew from the case. 

THABO BESTER, MAGUDUMAN AND CO-ACCUSED APPEAR IN COURT

Bester, who escaped from the Mangaung Correctional Centre in May 2022 and is detained at Kgosi Mampuru II Prison faces a litany of charges. Bester and his alleged girlfriend and celebrity doctor Nandipha Magudumana were deported to South Africa from Arusha, Tanzania in April 2023.

Addressing the court in June, Bester accused the state of depriving him of a fair trial. 

Bester said he has had five legal representatives who have all withdrawn their services because they fear being vilified for associating with him. Additionally, he is only allowed to consult once or twice for a short period of time and their calls were being recorded.  

He went on to blame the “backhand of political watchdogs” for the treatment he has been receiving.

“I came here with 80 cars; I woke up at 2:00. I’ve been having chains on my feet. My feet are ice. I cannot feel my toes at this point. This is not the way I want to proceed, your Honour.

“If it means that this court can accept the petition and the public can sign it, then we can put all this to rest. I am at peace. I know what I’ve done and what I have not done,” Bester said as he pleaded for a death penalty.

MXOLISI DUKWANA ELECTED FREE STATE SPEAKER

Dukwana gained prominence when he appeared before the State Capture Commission of Inquiry and made a number of explosive revelations surrounding the province’s former premier, Ace Magashule.

He was the MEC for Economic Development in the province when he appeared before the Zondo Commission.

Dukwana said Magashule did everything in his power to destabilise his department and for him to fail. He said the former ANC Secretary General had been interfering with his department’s work and processes.

“I am the only MEC during that time who worked with four different Heads of the Departments (HODs) from 2009 to 2012 and that was meant to destabilise the department. Every time a new HOD was appointed – and remember, at the time, Ace had no powers to appoint HODs – I would get the HOD who would come to me and tell me that he has been told to go help in the Department of Education and we will advertise for a new HOD,” he said.

Speaking after the special sitting, Dukwana said there is nothing sinister about his appointment.

“I am a servant of the people; wherever I am deployed, I always try to do my best. Even on this role, one is going to their best to ensure that this institution becomes alive and becomes the real voice of the people,” he said.

1. OUTENIQUA MOUNTAINS

A three-hour drive from Bloemfontein sits the Golden Gate Highlands National Park in the Free State and wintertime sees it get pretty snowed-up! Temperatures in the national park can drop to between an icy -9 and -15 degrees Celcius, creating perfect conditions for snowfall.

Bester and his co-accused appeared at the Bloemfontein High Court on Wednesday, 5 June, for a pretrial hearing. However, the matter was postponed as Bester’s legal representative withdrew from the case.

He further complained about being told what to wear in court. Bester’s choice of branded clothes have been the centre of attention whenever he appears in court. However, the Department of Correctional Services clarified that inmates – including those remanded in custody – are permitted to wear civilian clothing during court appearances. 

In an interview with Newzroom Afrika, legal analyst Abigail Ngubeni said Thabo Bester faces serious charges for his brazen escape, and the offences’ circumstances also touch on security inside prison cells. 

Ngubeni said you would expect prison officials to strike a balance between upholding the law and also providing security to ensure that the offences are not repeated. 

Ngubeni said Correctional Services officials should devise measures to ensure that the rights of detained accused persons are protected at all costs. 

Currently the budget airline offers Friday and Sunday flights between the two cities.

A new Wednesday afternoon flight will now give business and leisure travellers a mid-week option.

The flight will depart OR Tambo International Airport at 14:30 and take an hour and 10 minutes.

Flights will then leave Bram Fischer International Airport at 16:15, arriving in Johannesburg at 17:20.

Tickets start at R950 one way.

FlySafair was awarded the title of world’s the most on-time low-cost carrier

The distance between OR Tambo and Bram Fisher airports, should you wish to drive, is 425km and would take an estimated four hours and 10 minutes to complete.

Magudumana was allegedly assaulted by an inmate on Saturday, 16 March at the Kroonstad Correctional Centre in Free State.

CORRECTIONAL SERVICE PROBING ASSAULT ON DR NANDIPHA MAGUDUMANA

As previously reported, Magudumana was arrested in Arusha, Tanzania, with her partner, convicted criminal and rapist Thabo Bester. They were deported to South Africa in April 2023.

She is accused of fraud, defeating the ends of justice, violating a body, aiding and abetting an inmate to escape from lawful custody, corruption and arson.

On Monday, 18 March, Correctional Services spokesperson Singabakho Nxumalo said Magudumana laid a complaint of assault by another inmate.

Nxumalo said the department is investigating the circumstances following what was said to be a prayer meeting in a different cell from Magudumana’s.

“Reports of an alleged altercation and a push against the grills can be confirmed. DCS officials advised Magudumana to open a criminal case when she reported that she was allegedly assaulted. Magudumana opted to discuss it with her lawyers first.

“Furthermore, DCS Healthcare officials conducted an examination on her and found no visible injuries,” Nxumalo explained.

CELEBRITY DOCTOR ALLEGEDY THREATENED IN PRISON

In an interview with eNCA, Magudumana’s lawyer, Advocate Mochini Motloung, confirmed the incident.

Motloung said he was informed on Monday morning that fellow inmates assaulted Magudumana; apparently, one is a sangoma, and the other is mentally challenged.

“I received a call from my client informing me of the incident. I tried to do a follow-up with the head of the prison but to no avail,” Motloung explained.

Furthermore, the lawyer said there have been threats of violence against Nandipha Magudumana for some time. Even though the celebrity doctor reported this to the relevant authorities, nothing was done.

As previously reported by The South African, in October 2023 Magudumana collapsed ahead of a court appearance.

According to her lawyer she was dragged out of her prison her prison cell despite reporting that she was not well.

“She is not well, she is literally on the floor. I don’t even want to divulge any information that might further humiliate her…She is being treated in the most inhumane manner just because she is Dr Nandipha Magudumana,” he said at the time.

CELEBRITY DOCTOR ALLEGEDLY DRAGGED FROM PRISON CELL AND COLLAPSES

Just days after her bail application was denied, Magudmana collapsed at the Parkroad Police Station holding cells.

Her lawyer Motloung said she was brought from Parkroad Police Station to the Bloemfontein Magistrates Court holding cells.

Motloung said accused persons fall ill whether they are out on bail or in custody.

“She is not well, she is literally on the floor. I don’t even want to divulge any information that might further humiliate her…She is being treated in the most inhumane manner just because she is Dr Nandipha Magudumana,” he said.

NATHI SEKELENI WAS PAID R30 000 FOR SHOWMAX DOCU-SERIES

Meanwhile, Magudumana’s brother Nkosinathi Sekeleni confirmed that he was paid R30 000 to spill the beans on the highly-anticipated Showmax docu-series called Tracking Thabo Bester.

Tracking Thabo Bester is four-part investigation into Thabo Bester; why he was called the Facebook rapist and in jail originally. It also explores how Nandipha Magudumana fell for a convicted criminal and left her children behind to go on the run with him to Tanzania; and who really died in Cell 35.

“It is thus clear from clause four of the agreement that I was paid R30 000. This amount was in exchange for the exclusive rights I granted Idea Candy to conduct, record, and broadcast the documentary, not for commercial gain or any manner,” Sekeleni said in an affidavit.

The city of roses and the city of Durban will soon have a new connection in the form of flight services from Airlink.

According to Travel News, the reinstated service is part of the airline’s strategy to expand its network of flights from Durban as a third hub, with Bloemfontein joining Johannesburg, Gqeberha, Mbombela, and Harare as directly-served destinations.

The minor was kidnapped on Saturday, 6 January.

KIDNAPPED BABY REUNITED WITH FAMILY

Police spokesperson in the Free State, Captain Stephen Thakeng, said the baby’s mother came to Thabong Police Station to register a Missing Persons File after her girl (one year nine months) was kidnapped at a mall in Thabong on Saturday, 6 January 2024.

Thakeng said a preliminary investigation was conducted by the SAPS members together with Family Violence, Child Protection, and Sexual Offences Unit members, and video footage obtained from the mall showed a man taking a child and entering with her inside the sedan and driving off from the mall.

“The police initiated the search and visited all the gatherings of traditional healers in Thabong until the information came about Extension 15 Hani Park Bronville.

“The baby was found safe and returned to the parents on 7 January 2024. A 45-year-old male person was arrested for kidnapping, and he will appear soon in Welkom Magistrate Court,” he added.

The District Commissioner of Lejweleputswa, Maj Gen Tholie Afonso, has warned parents always to keep their children close to them, especially while busy with their shopping spree, and know their whereabouts, even at their homes.

The War Museum, also known as the War Museum of the Boer Republics, in Bloemfontein doesn’t only allow visitors some insight into the Boer War with it’s unique art collection and exhibits, but it also brings the visitor closer to understanding the background against which the war took place. Anyone wanting to learn more about South African history should definitely visit this museum.

The National Museum of Bloemfontein

Established in 1877, the National Musuem of Bloemfontein is a natural and cultural history and art museum. You will find all sorts of displays here, including palaentology, archaeology, geology and astronomy exhibits, as well as exhibits on African culture and Bloemfontein history. There’s lots to see and you can spend a whole day just exploring the length and breadth of the museum.

Oliewenhuis Art Museum

Oliewenhuis, a Neo-Dutch style mansion is located in one of the most beautiful gardens in the city of Bloemfontein. It is said to be the only museum of its kind in the Free State and is one of the youngest art museums in the entire country. The museum collects, conserves and exhibits works of art which represent the art heritage of South Africa. Be sure to check out the Sculpture Park and Cement and Mosaic Project in the gardens.

Social grants are an important part of many lives, and grant fraud comes in many different forms. If someone claims your SASSA card (or social grant) for themselves, then it is illegal and should be reported to the grant agency immediately.

Here’s what you should know about different types of social grant fraud, and what to do if you are a victim of these tricks.

SASSA: Fraud doesn’t pay

According to the South African Social Security Agency, they will ‘leave no stone unturned’ to find and combat social grant fraud.

Fraud doesn’t pay, and carries potential criminal imprisonment if you are found guilty.

Victims of social grant fraud do not receive (or get to use) their social grants in the way SASSA legally intended.

What is SASSA fraud?

Fraud is defined as misleading someone with false intent for your own financial or moral gains.

Social grant fraud includes claiming social grants that aren’t entitled to you. It is illegal to claim a social grant with false information!

Other forms of SASSA fraud can include not having access to your own money. This could be someone stealing your social grant, or using your SASSA card for themselves.

All foirms of fraud are illegal, and should be reported to the social grant agency and SAPS.

Social grant fraud can be reported to the National Hotline at this number: +27 80 060 1011

If you (or someone you know) is a potential fraud victim, say something. Reports can be made anonymously through the toll-free number.

You are allowed to have rightful, legal access to your own social grant (and card).

Any instances of crime can additionally be reported to SAPS by calling 112 or 10111.
